Em a\u00e7\u00e3o conduzida pelo escrit\u00f3rio especializado Naide Wolut Advogados, que tem como s\u00f3cios os advogados Bruno Naide e Felipe Wolut, a Justi\u00e7a julgou parcialmente procedentes os pedidos para declarar a nulidade do procedimento de consolida\u00e7\u00e3o da propriedade, cancelar a averba\u00e7\u00e3o realizada na matr\u00edcula do im\u00f3vel e invalidar todos os atos posteriores, incluindo os leil\u00f5es extrajudiciais.<\/p>\n<p>O caso chama aten\u00e7\u00e3o porque a senten\u00e7a foi al\u00e9m da anula\u00e7\u00e3o do leil\u00e3o, resultado que, por si s\u00f3, j\u00e1 representa uma conquista relevante em demandas dessa natureza. Al\u00e9m disso, declarou nulas cobran\u00e7as de tarifa de avalia\u00e7\u00e3o, taxa de administra\u00e7\u00e3o contratual e a imposi\u00e7\u00e3o de seguro vinculado \u00e0 seguradora do mesmo grupo econ\u00f4mico da institui\u00e7\u00e3o financeira, pr\u00e1tica reconhecida como venda casada.<\/p>\n<p>Ao fundamentar a decis\u00e3o, o Judici\u00e1rio reconheceu que a institui\u00e7\u00e3o financeira n\u00e3o observou os requisitos legais para a constitui\u00e7\u00e3o da mora.
