No entanto, segundo a defesa apresentada pelo escrit\u00f3rio, ela n\u00e3o teria sido regularmente notificada sobre a possibilidade de purgar a mora \u2014 etapa obrigat\u00f3ria prevista na legisla\u00e7\u00e3o que rege a aliena\u00e7\u00e3o fiduci\u00e1ria de im\u00f3veis.<\/p>\n<p>A autora tamb\u00e9m sustenta que n\u00e3o foi formalmente comunicada sobre a realiza\u00e7\u00e3o do leil\u00e3o extrajudicial. A primeira informa\u00e7\u00e3o sobre a perda do im\u00f3vel teria ocorrido por meio de uma liga\u00e7\u00e3o telef\u00f4nica de terceiros, que afirmaram que o bem j\u00e1 havia sido arrematado e que ela deveria desocup\u00e1-lo.<\/p>\n<p>Na an\u00e1lise inicial do caso, o ju\u00edzo destacou que a legisla\u00e7\u00e3o exige a notifica\u00e7\u00e3o pessoal do devedor para que possa quitar o d\u00e9bito em atraso antes da consolida\u00e7\u00e3o da propriedade em favor do credor.
